    Under review for discharge

Have been going crazy for a couple months trying to figure out what npoc meant. That's what my case status changed to on the NDC web site. Also had the money in the bank for this month's Ch.13 payment but it was not deducted as of a couple days ago. Finally got up the nerve to call Trustee's office. We have always been told NOT to call there but call Atty.Well our Atty. is not the most pleasant person to talk to,so as I said I finally called the Trustee office and the lady was very pleasant.Said our case was under review for discharge and they had stopped taking payments from our checking account since the balance on hand was more than the principal owed.I was so happy all I could do was say thank you and hang up.NDC still shows funds have not been disbursed to pay off creditors this month. My question is does anyone know how long it takes to get discharged after payments stop and what does under review mean? I am not spending one penny of that payment in the bank.I just can't bring myself to believe this may finally be over.We were supposed to pay 49 months and they have only deducted 40 payments thus far.
Another question is what happens when the IRS does not file a claim and does not get paid thru the plan? They were included in the schedules but like a couple other unsecured creditors did not file a claim . Hope someone can help answer these questions.I'm more nervous now than I was when this all started believe it or not.I just want this to all be over and be able to have a new start in life. It's really been a tough 40 months.Husband had quad bypass two years ago.Thank god he had Medicare, but we were still responsible for a couple thousand .Just paid that off last month and am still paying medical bills for an accident I had over a year ago.Didn't have the extra money to pay Ins. for me.Sorry to ramble on.I know we're not the only one's with problems and it could be worse! Thanks again for listening.

So glad that you have successfully reached the end of your long Ch 13 journey, NN! Congratulations on achieving what only 30% of Ch 13 filers can manage - finish their plan!

From what I've read and heard here and on other bk sites, you can expect up to 60 days for the trustee to finish up bookkeeping and ensure all creditors are paid. Then he/she will discharge and close your case. Enjoy spending that extra payment and welcome to your new financial start! Please come back and let us know how your rebuilding is going, and again, congratulations!!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Congratulations Nervousnellie!! And welcome to that 30 percent club... we just joined recently ourselves!! I'm so happy for you!!! And wish you well in the future.. i know exactly how you feel and was so nervous not having to make anymore payments!! It's kind of scarey to say the least.. my advice is to save that payment every month like you still have to pay it.. you'll have a little something left over after finishing up the closing part of this process..

For us, we got that notice on Jan 26th (stop making payments), discharged on March 8th, and trustee just closed our case on April 25th... hope that helps in figuring your timeline.. congratulations again!

Congrats on finally reaching the end!!!!

Is it really true that only %30 of 13'ers finish their payment? Wow, that's suprising. I am in my last 3 months, last payment goes out July 1st, but from the sounds of it, it won't truly be over until all of the paperwork is completed (2-3 months from what I am reading).
