    Moving To Soon?

    Hello all,
    just had a quick question
    if a relief of stay is granted and your house will soon be in foreclosere
    and you find another house to rent because you know eventually you will
    have to leave and this is the only rental that you have found that you can afford and who will rent to you while in chapter 13.how soon is to soon to move?can you move as soon as you know the relief of stay is granted or do you have to wait awhile untill the forclosere has started?

    I wouldn't think the relief of stay would be at all related to moving, except that now you can expect the foreclosure process to progress. Are you asking CAN you move or SHOULD you move?

        There is nothing stopping you from moving anytime that you want to. You are still responsible for the house until the foreclosure is complete, but you do not have to live in it. I would at a minimum keep insurance on the house, other than that there are no laws that I know of that require you to stay.
