I filed Chapter 13 on 6/21/07, my creditors meeting is on 7/16/07. My question is I owe like 565.00 on past due insurance premiums, I was unable to pay it due to filing Chapter 13, is there anyway that the past due amount can be included in my chapter 13 plan?

What kind of insurance is it? Home? Car? Life? Other?Originally posted by missem View PostI filed Chapter 13 on 6/21/07, my creditors meeting is on 7/16/07. You need to understand that if you do list the insurance company on your forms, several undesirable things may happen as a result.
First and foremost, since you listed them as a creditor on your bankruptcy, your insurance company may either drop you as a customer or increase your rates dramatically.
Since you are currently in arrears, depending on the insurance agreement you signed, if the insurance is for your home or car, you may not be considered insured until the arrears are made up. That isn't going to happen for a *LONG* time in Ch 13 because your trustee pays off your secured debt in total first, then the priority debt in total, then last he pays the unsecured debt like your insurance (and then only if they file a claim and may only get a small % of the $565 if your plan isn't paying back 100%).
Chances are since your 341 meeting hasn't happened yet, if you have no other way you can make up the arrears and accept the risks of including it, the insurance arrears still can be included. Be sure to ask your lawyer what's best to do in your circumstances.Last edited by lrprn; 07-04-2007, 12:15 PM.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
