    Early 13 discharge?

    Has anyone been discharged after only one year in a 13? I'm in Ga. We are 100% pay, comes out of hubbies check weekly . All of our creditors that filed claims have already been paid their 100% as of June 1, 2007, including the lawyers fees, filing fee and trustee pay. Our lawyers paralegal says its not uncommon since we are 100% pay.She says it may take 90 days before we hear anything from the trustee since they have to do an audit first. We pay our 1st and second mortages outside of plan (direct pay). As of May 2007, we paid in full on the 1st mortage( we only owed 1 year on a 15 year mortgage when we filed) .Thank the lord for this extra money each month. This waiting is driving me crazy. Just want them to stop taking the money out weekly since there is no one left to pay. I looked today on 13 data center and we are sitting on $3200. Has anyone else experienced this? I know its a good thing, but ..... Would it be pushy if I called the trustees office myself ? I sure don't want to step on anyones toes or make the trustee mad by asking questions. Thanks, just needed to vent a little. Love this site.

    If your represented by an attorney, it is better to push the attorney to try to get the ball rolling.

    But, it is par for the course that once all creditors have been paid in a chapter 13, it can take the trustee anywhere from 2-6 months to audit the account and have it discharged.

      Thanks HHM, I'll call attn. on Monday to see what the status is. Hopefully he can jump start this. I did check Pacer and no new filings yet.

        Update

        I got up the nerve to call the trustees office early this morning because I could not get in touch with attn who is out of town. They were so very kind and helpful and I was told that my case should be up for audit at the end of this month, and if everything works out and all have been paid what they are owed then they will send an order to employer to stop taking payments out. Hopefully our end is near. Please pray that it is, I know that we are.

          Good for you, gamom! Always hard when after years of Ch 13 payments you are finally so close to the finish line, yet still waiting. Luckily you will eventually get back any extra removed from your paycheck after your case closes. Hope your closing happens as soon as the court clerk thinks it will be!
