    Exactly when does

60 months end? Is it 5 years from:

    Date Petition Filed 9/18/2003
    Date Plan Filed 9/18/2003
First 341 Meeting Date 10/22/2003 or the
    Date Case was Confirmed 11/21/2003??

If I remember right, I made a payment before the case was confirmed......like when I filed?

I know the end is in sight but I'd like to know for sure...AND then a year or so back someone from the trustee's office informed me that 60 months of paying won't quite cover the set amount and that I should pay a bit more each month to cover the shortage?
That seemed odd to me in that I've never received any notice about a shortage.

Calling the office just is not something I want to do.
Has anyone ever had this happen?

    Thanks,

    Judy

Your 60 months in Ch 13 should end the month that your case was filed - for you, September 2008.

Did you file with a lawyer? If you did, contact him/her and ask about the mystery "shortfall".

If you filed pro se, does your trustee use 13Network - http://www.13network.com/ ? Click the link then scroll down and check your state. If your trustee's name is there, you can enter their special site and see a lot about your case there for free , including when your case is due to end. You can sign up for a free 13Network user name and password on your trustee's homepage.

If your trustee doesn't participate in 13Network, then you can check PACER. See http://pacer.psc.uscourts.gov/faq.html if you haven't heard of PACER before. You can check your Ch 13case status here for free as well.

    Hope this helps!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Even though we think of the Chapter 13 plan in terms of months, it might be easier to think of it in terms of "number of monthly payments". You will need to make 60, monthly payments to the trustee. However, it really does not make much difference, you have to make your first chapter 13 plan payment within 30 days of "filing" the petition, so in most cases, the plan term will be 60 months from Petition filing date.
