    Waiting for my Dismissal Letter What next?

    I am about to have my BK13 dismissed due to gettting behind in my payments. Has anyone been down this road? Are the collectors hard to deal with after being dismissed? How hard is it to get a new car loan? My current car has 115,00 miles on it and is about to quit on me.

    Have you spoken with your lawyer to see if you can file an amended plan rather than be dismissed? When did you file?

    Yes, any time a bankruptcy is dismissed the creditors come roaring back with a vengeance. They will pile on late fees and if your APRs weren't increased before you filed, they will be now. They may also start legal actions (garnishment and liens) more quickly than before you filed.

    Getting a car loan with a very recently dismissed bankruptcy is going to be very difficult - the terms are going to be outrageous if you can find a lender. That's why your best option is to try to save your Ch 13 if at all possible. Call your lawyer!

      I have been in the BK13 for 2 and a half years. I have would have two years to go.

        and there is no way to convert? I have had a chapter 13 dismissed due to non payment of the plan. It takes about 6 weeks for the creditors to come out of the woodwork and believe me they will. They will tack on all kinds of late fees and penalities etc. Your other option would be to refile your chapter 13 and get a new budget in place and start over, hopefully one that is more suited to your needs and will be easier to maintain. As soon as you receive that dismissal letter, I would be talking to another attorney and getting a vehicle that would last through a plan in the meantime. Then include it in the chapter 13 to stop the outrageous interest you will be charged.
