Finally got up the nerve to call my trustee's office

to see why they didn't disburse all of the money that came in. The person I talked to told me that they didn't disburse the amount left sitting in my account because it didn't make it in before the 27th of the month. I pointed out that they took 12 cents out of it, and he informed me that the 12 cents must have been leftover in the account . Well I am not one to argue, so instead I asked if he could tell me about how long I still had in the bk. He transferred me to someone else, who of course wasn't in her office. Left a voice mail with my home and cell numbers on them. So I guess tomorrow I will smuggle my cell into the OR with me, on vibrate. I figure since they close in 30 min she left early and it will be tomorrow before I get a call back.

And darn it, is there a smiley code for frustrated to the max??

I am also wondering why no disbursement has been made this final month. I sent in #36 almost 3 weeks ago, it posted as recieved on 13datacenter website, but no dispersement has been listed as of 9/13.

It seems like trustees do this just to prolong the agony! Geez, havent we suffered enough?

Seems like they would want to finalize things.

Although finally reaching the end of your endless Ch 13 plans then having to wait for discharge must feel like agony, the trustee is required to audit your plan and double-check all payments provided to each of your creditors before your case can be closed.

Depending on the complexity of your case and how many creditors were involved, this audit can take anywhere from 2 to 6 months after your final payment is made. Be patient, grasshopper (I'm giving away my age with that line - LOL! )

Ask your lawyer to ask your trustee for an update on your case and when your discharge may come through.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

      06/01/06 - Filed Ch 13
      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go
