    worries every go away?

    Hi am new to the board. I have been lurking for a while now.
    First of all I just want to say thanks. Just being able to read about this has made it a little easier.

    We filed in March 2007 and have a 3 year plan. Do you ever stop worrying if you will mess up and get your case dismissed? I know I am paying on time but still stress when I get the mail. Our payment is taken out of my husband's check so we have our mortages to pay. So I am sure I am just being a worrywort.

    I tend to stress over this stuff and want to know if it will get better or I will be this way for 3 years

    Hi CM - glad you decided to come out of lurk mode and join in our forum fun!

    Assuming your Ch 13 plan was confirmed, then unless something unexpectedly changes your financial situation significantly, it's be sure to pay the trustee on time every month and stay under your trustee's radar until your 36 months are up. Even if something unpredictable does happen, your case still won't be dismissed. You just notify your lawyer immediately and he/she asks your trustee if you can skip a payment or, if the change is long-lasting, files an amended plan.

    Worrying is understandable - I like to worry myself - but there needs to be a real something to worry about. Otherwise it's energy better spent on your family.

    In my case, I was very stressed and worried for months after we filed but that has eased a great deal as time has passed.

    I finally realized all my worrying wasn't accomplishing a darned thing except make me exhausted and sick. My family was also getting really tired of their "gloom and doom" mom and wife, so I made the decision to create a strong family budget and focus on that instead. Once I started paying attention to something else that was helping our situation a lot more than my hand-wringing , my anxiety decreased a lot. So far, so good!

      I've been in BK since the beginning of the year and had a vehicle totalled that was not under a lien, but was noted under the 13 plan as an asset and received a check to pay for it's value. The check was about $1K more that what we wrote in the plan based on the Blue Book value I used to list it under the plan. I did not think of it at the time of the accident and started thinking about it 2 months later after I had used the money to buy another vehicle and read through some of my paperwork about not selling or buying vehicles. I lost some sleep worrying about it and trying to find info on the web - which led me here. I explained my situation and had some good responses, which all basically ended with "contact your lawyer to be sure." My lawyer explained that everything was OK and I was able to get some rest. I am not nearly as knowledgable as many here, but the things I recommend are to be concious of how you spend your money, make sure your payments or on time, utilize the knowledge in this forum, and contact your lawyer if you really need to know something. We are all in the same boat here and have made many of the same mistakes. I am glad I found this site and everyone here has been very supportive.

        I didn't worry about it because my payment was taken out of my check directly.

        Then I split up with the guy I was seeing. Worried alot after that cause but it was about making the other bills (electric at around $200/mo, child care at $400/m, phone, trash/water/sewer, and tv) I came up every month about 200 in the hole. Luckily I have a wonderful family who volunteered to watch my child for free.

        Got back together with boyfriend, got pregnant, had to take a leave from work, boyfriend's car broke down and he used mine, ended up crashing it and it being totalled. Could not return to work. Borrowed money from dad to get car fixed, boyfriend returned to work (since he makes more than me). Had baby, got married, and finally got a car back.

        To sum it up, a lot of crap happened to make us so far behind on bills that we can't catch up (even with husband working 7 days a week for 4 months straight) Ended up converting to a chapter 7.

        Oh, and if you're wondering, we were like 2 payments behind in our payments to trustee. We actually caught that up just to fall back behind again. That's when we "I" finally converted to a 7. The trustee had a court order stating that if we were late on our agreed payment for arrears that the case would be immediately dismissed. When I realized I couldn't do it anymore, I contacted lawyer to convert.

          My payment comes directly out of DH's pay so I don't worry about that and I am determined to get through this and get discharged.

          The only thing that I worry about is if something huge happens and I can no longer make the payment. But then I tell myself that is what I pay my attorney for....let him worry about the big stuff.
