    Changing jobs

Here is the question I need to ask.
    I filed BK 13 in Dec. 2005.
My payments are 1025 per month, due at the end of each month. This 1025 includes my house mortgage. I was 3,000. in arrears on my mortgage. As far as I know, this has now been paid off. I got my mortgage statement and it is up to date. If I was to lose my bk 13 will I still have the mortgage company coming after me?

I am in the process of changing jobs. Instead of getting pd every Friday, it will be on the 15th and the 30th. I will be getting pd my last cks onthe next 2 fridays. I do not know what my commision will be this wk. I do not know if I will be able to come up with the full 1025 this friday. I will have at least 800.00. I can come up with the other 225.00 the following wk. What can I do? My attorney is easy to talk to and get a hold of. The reason I am changing jobs is because my old job will now be based on mostly commision and I do not like this.

Call your attorney and let him/her know immediately why you can't make your payment this week on time and that your income will not be steady in the coming months. Your attorney will notify your trustee who (hopefully) is one of the understanding ones. Sometimes they will allow a late payment if they know the circumstances.

Now that you have an unpredictable income because of working on commission, you must get in the habit of putting aside all extra $$ and anything else you can scrimp and save on the good months to tide you over in the bad months. It's tough but the only way you'll make it over the long haul. Hang in there.

If after 6 months your income looks like it's going to average lower in this new job, go back to your lawyer and see if an amended plan to reflect the lower income is a good idea.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
