Can I ask what your experience is on these companies filing claims. I'm hoping that they will not being that I will be at 100% payback.

Both Chase and Amex filed a claim indirectly in that they sold the debt to someone else. (I actually believe Amex hires the company that made the claim to manage it for them) Citi was the only creditor who didn't file a claim....and it was over 30K in debt.
Chase didn't file a claim until the last week.Chapter 13 Filed 4/03/06  341 Meeting Complete 5/11/06 :yes2:

My experience in our Chapter 13 (54% payback to nonsecured) was that the creditors having the largest balances due them filed claims. Those with smaller balances due did not. That doesn't mean, in your situation, that will occur. As one poster already stated on here, expect all to file. You will not know who will or will not file claims until they are all in.Originally posted by busbis View PostCan I ask what your experience is on these companies filing claims. I had AMEX and they did file a proof of claim. They are pretty heartless. As soon as they received the bk notice of filing they sent me a really nasty letter. Oh well, I am sure that they got over it; I know I did.

What was the nasty letter about? I'm surprised AMEX stooped to that level...Chapter 13 Filed 4/03/06  341 Meeting Complete 5/11/06 :yes2:

So far in my 13, Amex hasn't filed any claims themselves...One of my Amex accounts did get to a local collections attorney (I was probably going to get served with a lawsuit very soon) and his office did file a claim on behalf of Amex, but they haven't filed claims yet for the other two so far.
In fact, not very many creditors have filed claims at all.Oct 9, 2007 - Filed my Chapter 13!
Scores: 527/509/528
Jan 1, 2009 - Sent in my last payment! Scores: 635/628/585!
Feb 11, 2009 - DISCHARGED & CLOSED!

Hi-I'm a newbie here, but thought I'd add my two cents.
AmEx actually filed motions against our plan because they didn't feel as if we were putting all of our disposable income forward. They then had the hearings continued 4 different times. Finally at the last hearing in November (our 341 was in June), the laywer showed up, told the Trustee he would agree to whatever he agreed to, and walked out.
The best part is.....while they filed motions, THEY NEVER FILED ANY CLAIMS! Between DH and I, we had 4 cards totalling about $30K, none of which they filed claims on. Our case was confirmed on 11/7, so they are out of luck. I still check Pacer weekly, and so far, nothing!
Not sure what the future holds, I'm sure they'll be out to make our life suck at some point, but I'm going to continue to gloat for awhile. They also cancelled my corporate card (even though it was current), so I'll probably never get that back, but after making our lives miserable for 4 months, they got what they deserved.
On the flip side, Chase filed claims on both of our cards.
