    Just found out that I now have (2) $125.00 attorney fees and (2) $9.50 property inspection fees on my 2nd mortgage account. I called and asked what they are for and they said because I'm in bankruptcy. I asked what the attorney fees were for and they said they'd have to get back to me and that they didn't know if those were monthly fees or what. My payment is only $320.19. Can they really charge me $250.00/month for attorney fees or is this probably a one time fee. I'm freaking out! They also said that they send someone to drive by my house every month that I am "contractually" 30 days over do. I'm currently contractually due for October and November. I only had 2 months arrears. I paid my post petition on time. Guess I'll get $9.50 fee for this each month to. Any advice?

      Time to force your lender to come clean, klux. Call your lawyer - he/she needs to be involved in this from the start. Is PACER showing any unusual activity recently?

      Start by sending your lender a HUD RESPA letter asking for a complete accounting of your loan activity for the past year. They can't ignore this - it's the law. Here's an example of a RESPA letter - http://www.hud.gov/offices/hsg/sfh/res/reslettr.cfm

      Depending on what your lender reveals, if you still can't sort out what is going on, then your next step is to ask your lawyer to send a letter to your mortgage company demanding to know why they are adding attorney fees to your account. That should do the trick.

        I don't have a mortgage in my chapter 13 currently but having lurked around the boards for a long time, many have posted about their mortgage companies taking them for a ride with excessive fees. I would get your attorney involved right from the get go so this can be stopped.
