    have to be almost done, right!

    I'm so glad I found this board! I can't believe it took me so long. My hubby and I are in the last months of our chapter 13 and I'm telling you, we are just so tense and anxious!

    We filed and made our first payment 36 months ago in early November 2004. I called our trustee's office yesterday to try to actually get someone on the phone to tell me when we would be done and can finally stop making the painful payments.

    13datacenter says we are still 'active' in our case status and I can see we have an extra $1000 paid into our plan base already. Tomorrow is my payday and we do direct payments from my check so I know I'll be seeing another payment come out.

    Anyway, just wondering what you all thought. I'm in NYS. How I long for the day when I see something other than 'active' in the case status area ... it seems like so long since we filed even though it was just three years.

    You have got to be excited!! I'd try again to get someone to answer your question at the trustee's office.

        Yup, they did tell us! 36 months was our plan ... I think we're just anxious because we are in our 36th month/payment and trying to get someone in our Trustee's closing department is so frustrating. All we want to know is that we are done and they are in the process of closing our case. This was probably more of a vent than an actual question.

          I know the feeling. Been waiting for discharge papers from the Judge since September (almost 3 months now).

          13datacenter has said "plan complete" for 2 months now. Waiting is quite agonizing.

            I hear ya JRT! It is so agonizing.

            Well, I FINALLY talked to someone in my trustee's office and she confirmed that we have in fact we made our 36th payment last week and "completed" our plan payments. Since my trustee's office does monthly disbursements, the final disbursement still needs to go out to my creditors, which won't happen until sometime next week (in December). THEN ... they will start the audit on our case, which will take 4-6 weeks. So, hopefully by early-mid January we'll be closed.

            In the meantime, they will keep taking money out of my paychecks! SIGH! I understand the logic of continuing to pay but it's so painful. We have a very high monthly payment and when I think about what we could be doing with it, esp this time of year, it's going to make it hard. My trustee person did point out that we'll probably get a refund, which I estimate will be nice chunk of change in the long run but it's still a hard pill to swallow. oh well, almost there!

              congratulations on making it this far. I met my base mid october and the payments continued to come out here is the timeline of what happened next

              November 1st trustee made 2 disbursements one for my mortgage the other a nice big check for me.

              My job pays weekly so 2 more payments came out before job got order to stop deductions from bk court.

              November 8th order to stop payroll deduction

              November 11th discharge showed up on PACER

              Trustees office said they will refund the rest of my money to me December 4th.

              While its no fun watching YOUR money sit there the refund was a good way for me to begin my fresh start with a savings account etc. etc. Oh yeah and my "christmas in mexico" vacation

                Congrats on making it thru your Plan!!

                Unfortunately, some Trustees are a bit lax when it comes to shutting off the pump, so to speak.

                Several other people have reported the same thing. Making a couple extra payments and then getting a refund after the Audit.

                I know it doesn't help much now, but just think of the nice things you can do for your family when you do get the refund. Maybe a long awaited treat. Or open up a Savings Acct with a nice, tidy little sum of seed money.

                Congrats again!!

                It's always especially nice to see a successful 13'er chime in that they've completed their mission!!

                    Wow! You all are great (so supportive) ... it's been such a tough road but you all are SO right; it's just a little longer and the $$ we hopefully get back will be a nice treat to have. Also, reading what some of you have gone through already makes me feel better. I think this type of 'situation' can make you feel very alone and unsure if what you are experiencing is the norm (i.e. the long wait, payments still being made etc.). Hubby is a little anxious so his stress has been weighing on me and it just feels good to let it alllllllllll out. I'll keep all posted on when we FINALLY get the official word!!!
