    ADVICE needed about bonus!

    We filed bankruptcy and it was confirmed. In our plan we are paying an additional amount of money each month in order to be able to KEEP our bonus that we get in December. The monthly amounts we have paid in totals $5080.

    We just got our check and the amount is over $5080 by $600 and so I emailed the lawyer to find out what we should do with the amount that is over. Should we: keep it, write a check to the trustee for the $600 over or do we just put it in the savings account and wait to see if the trustee asks for it.

    All I heard from the lawyer was in the beginning when he asked me how much over is it and when I told him I have heard NOTHING back and it's been 4 days.

    At this point I don't know what to do? Has anyone paid in money to keep their bonuses or vacation checks, etc. instead of turning them in?

      Hold onto the money until you get an answer. If you do not hear anything in about a week or so, inquire again.

        If his bonus was less, do you think the trustee would give you a refund? I probably wouldn't spend it until you hear from your attorney, but I bet they will let you keep it.

          do you know what's "funny" about the whole thing. I wrote him twice. once on thursday to tell him that i thought it was going to be "over" the amount we paid in........he wrote right back and said "how much over" and i told him i would know on saturday morning.

          then i wrote back saturday morning and told him the amount and said, what do i do, keep it, hold on to it or send it to the trustee.

          it's now WEDNESDAY and i have heard nothing. it's almost like the answer is go ahead and KEEP it but i can't tell you to keep it.

            That is exactly how I felt at my lawyer's appointment Monday. I put down a LOT for gambling losses and the lawyer told me I "didn't want to shock the court" but he couldn't tell me to lie under oath..He told me 3 times that he couldn't tell me to lie under oath...well he did really, didn't he? I thought it was kinda funny and made me feel like he is on my side. Today when I filed I upped it a little bit ($5,000)so the courts wouldn't flat out tell me I was lying because over a few month period I took out some hefty cash advances. I went with what I thought was "safe".

              yes i understand what you mean. now it's friday and i have not heard anything and i'm not going to bother him with it again. If he felt i should send it in, he would say, YOU better SEND it in but he can't tell me to keep it ...even though it's really a small amount of money so what i plan on doing with it is put it in savings and never touching it unless questioned about it.
