    Need help with a question

    We filed for a 7 but was moved to dismiss and lawyer is going to change it over to a 13 in January. We have had some bad luck with car repairs to both vehicles this month and our bi-annual car ins. is due and we have 2 kids that we need to provide at least a small x-mas for. My wife has a life ins. policy that has some cash value that I am the beneficiary so the BK courts have no right to it in a 13 or a 7. We really need to take like a $1000 loan out on it so we can get through this month. Can we get in trouble for this? Last thing I want is to jepardize my filing but I need the cash or I will not be able to pay for car ins or provide the kids with any type of X-mas. I don't see how they would ever find out about it but want to be sure.

    Any input would be appreciated.

    Speak to your lawyer first to make sure this new loan won't mess up your filing switch. Because the loan didn't exist when you first filed, ask your lawyer if you will be able to include the loan payment as an ongoing expense after you file Ch 13.
