    We just got confirmed last month. I know each trustee varies and I will call my attorney on Monday, but here is my question. We are about to file our taxes. Our plan was 100% payback at 36 months. Well due to some creditors not filing and the 4 months we have paid we are down to 24 months now. Do you think the trustee would keep our refund since the minimum payback is 36 months?

    my understanding is that the trustee ALWAYS keeps the refund. At least that's what my attorney said.

    But in your case I don't know. You only owe 24 months to begin with so they may let you keep it.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

      I think if you are at 100% payback you might be able to keep your refund! search the forum for info I know I read this before!

        Tax refund rules vary district to district, but if you are in 100%, then you cannot pay more in than your owe, so you should be able to keep it or payy off your debt.
        Filed CH7 - 10/13/05;
        341 Meetings: 11/28/05, 3/20/06, 12/4/07 (3d time's a charm!)
        Converted: 2/15/06 (to CH13), 10/15/07 (Back to CH7)
        DISCHARGED: 2/15/08

          when I filed, old law, my atty said trustee only wanted refund if payback was 20% or less to secured
