electronic refund- can my refund be confiscated?

I was reading the fine print about the $29.95 charge from HSBC to transfer your refund to your bank account. (on the H&R block website). It mentions something about HSBC has the right to use the refund to pay outstanding debts that may be owed to HSBC or its affiliates. It does say that it cannot apply the refund to those accounts discharged in bankruptcy, but does not state anything about debts currently included in Ch 13 cases. I'm not sure I should risk using this type of service. I need all of my refund to fix my main roof on my house and replace my garage roof. I got permission to use the refund, so I'm not trying to use my return without the go ahead from the trustee.

Anyone have experience with electronic tax filing with a service (like H & R Block) and confiscation of funds?

word to the wise..... I spoke with my tax rep at H&R and she told me to just pay for the return prep fees with my debit card and then e-file directly with the IRS. That way I don't have to worry if HSBC would try to use my refund to pay off debt. I did have a car loan with them. I surrendered the car, but there was about $8000 worth of fee's left over from the loan. So I'm not taking any chances.

Think about this if you are considering using speed pay, an HSBC provider when paying for your tax prep fees online. I'm so glad I read the fine print!

Hey, I answered my own question.
