    I Filed C13 Today

    Well the first step is done. We did an emergency filing due to not wanting to count our February checks which where quit high due to a profit sharing check in our means test calculation...The attorney believes it will be an easy 13, he said we got a great judge who is debtor friendly and a geniune nice person and a great trustee....He was very happy. He said the other judges are creditor friendly making the process more difficult. We will finalize the rest of our required schedules next week.

    He said we will be looking at a payment of around $500 or so....on a not so nice note their are collection accounts that my husbands son had were he fraudulanty used his father S/S number. The attorney advised us to leave them on so that they can be discharged in the C13...who wants to be hounded for some elses debt (I HATE MY HUSBANDS SON AND WISH HE'D FALL OFF THE FACE OF THE EARTH, HE'SW A DRUNK, ABUSIVE, LIAR, SCUM OF THE EARTH).

    I am looking forward to moving forward to a brand new future with more lightness then I have felt in a very long time.

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      I second the welcome. Us 13'ers have to stick together. Just stick to your budget and you will be okay. Good Luck!

        Copy cat filed same day I did I wanted the day all to myself now the courtroom will be crowded Good luck and stay with us in the forums to help and advise others too whats happening......
        Started in Chapt 13 Switched to Chapt 7 Discharged 2009 Dec.........Filed New Chapt 13 in 2010 to deal with new surgery bill and stripped second mortgage! The story continues

              lrprn - Thank you and yes I will enjoy that feeling of lightness.. I will definitely keep everyone up to date and offer advise and request advise as we move through this process.. I have to admit that I am nervous about the payment though...that $500 estimated was from my means test only they have not completed the schedules yet.

                Hate to burst your bubble, but wanted you to know they will go over your February paystubs at your 341 meeting.

                You should be able to tell them it was a one time increase, but it will be asked. My paycheck went up by less than $100 and it was brought up.

                  isitreal I am aware that it will be brought up, and yes it is a one time profit sharing check that is based upon the company's profit...the way things are going there won'tbe profit sharing next year. I work for a majot airline and with the cost of oil at $100+ a barrel and industry merger talks it going to be an interesting year.

                  Also my husbands paychecks have been high due to a large amount of overtime...this is only in preparation for a grand opening of two senior living facility and then the overtime will be no more or minimal at best.

                  So we are in for a lengthly discussion. I am not looking forward to our 341 by any stretch of the imagintion. Just hope our explanations will be enough that the judge will grant us some mercy.

                    Hey Debt when I did means test it appeared I was going to pay $1000 but when they completed the schedules after much back and forth the payment went to $1700 which
                    is fine for me... Its piece of mind knowing I have one payment and not 43 people calling me
                    with threats..... Hang tough and will be brighter days

                      Car, does that include mortgage arrears or is that just unsecured?

                        It is just debt and taxes. My mortgage has never been late and I kept it out of the plan.
