    Contact your attorney to see if you can get your payments readjusted. I don't recall offhand (anyone?) but there is a wait period between the time your case is dismissed and the time you can re-file.
    Chapter 13 Filed "Old Law"
    Filed: 6/2003 Confirmed: 3/2004
    Early pay off sent: 10/05/2007 - 9 months early
    11/16/2007 - Discharged!

      I believe it is six months before you can refile a Chapter 13 but don't quote me on that. However, to the OP, since there is a drop in your income you should be able to get your Plan modified but I am thinking that you may not have reported the increase in your income after filing to your attorney and trustee and your attorney is going by the amount under which you filed. Are you now making less than that? Did your income drop below the amount under which you filed? If you are not, then your plan probably cannot be modified.

        I have explained to the attorney that i wasnt pay federal tax claiming exempt and work 20 to 50 hours of ot per month. gross anywhere from 6 to 7K She said they go off gross pay not what you take home. Now come Feb 2008 and gross 4G and taken home after taxes and 401k loans 800.00 bucks every 2 weeks. WOw i just recvd email from her that she has got my payment to 480.00 per month and filed that but she needs me to file my taxes she estimated i owed 5000 in back taxes. but that still doesnt leave enough for rent 500.00, insurance 100.00 and gas,food Cali is expensive 500.00..wow i left with a big 20 bucks...my i will just go with it for a few months then get it modified.

          bankrupt means no money left over is consequences of ones actions.
          be creative and find extra jobs or tasks that can pay you cash for
          services? Cash that is not in form of paycheck.
          Started in Chapt 13 Switched to Chapt 7 Discharged 2009 Dec.........Filed New Chapt 13 in 2010 to deal with new surgery bill and stripped second mortgage! The story continues
