    extra money

    We are planning to file 13 soon. I meet with an attorney on Tues. My question is my husband got a 10% raise a month ago. Now we have a little extra money left each month. We were running pretty tight up till that point. I havent' paid cc's in over 6 months. I didn't have the money for those anyways... that's why I stopped. I was paying on 3 cc's that I've kept up with. From the posts I've read it said don't bother to keep paying on those 3 if you are going to file anyways. SO ...if I don't pay those this month I will have $200 extra plus the extra 10% from the raise. Thats about $1000 at the end of the month. I haven't had that much left over in months. NOW the big question is I need to pay my son's high school tuition. It is about $2200. If I pay it over the next 2 months from the extra money will there be a problem. Preferential...treatment? The IRS allows $137.50 a month for tuition for children from the means test. Do I do it now or hope the trustee will allow it later.
    I also recieved my tax refund of $6000. I've spend $1k on essentials, groceries, doctor, dentist etc. (all necessities). I put aside $2500 for attorney's fees and that leaves me a little left over.
    Any advice would be helpful. I know that I won't have much left over too spend after Chapter 13.
    We are about $6700 a month. $95k unsecured debt. 5 kids. Live in NC- not sure what the money in the bank account exemption is.
    Any help would be appreciated. Thanks in advance

    I am interested in find out similar info...we are pretty much in the same boat as you, with very similar debt loads and income

      Did you ask the attorney about your son's tuition? If your son is going to be a junior or a senior, one would hate to have to move him to another school. That is a large chunk to pay prior to filing but you might have an argument if your son has been going there a few years. If you are going to retain that attorney and file soon, I would certainly ask him before paying it.

        I was reading PACER one day and came across a case where the filers pre-paid tuition for the next year and the trustee went after it from the school. I'm sure it just depends on the trustee though.

          Yup and they could go after that 6,000 refund as well that you just got couldn't they?
          You need to make sure you re-adjust your taxes so you get no refund next year or trust me, they could snatch it!! $6K is an awful big refund and the trustee will be smacking his lips!
