    Filed BK in February. Question about 2007 taxes.

    I filed BK the first week of February. Last week I had my 341 Meeting and it was a breeze.

    My question is this. I owe $1,150.00 in taxes for 2007. My lawyer put it into my BK and added the IRS on my list of Creditors so they will be paid in full through my BK plan, just not until my lawyer and the trustee get paid. Although I have did my taxes and know what I owe I have yet to mail my 1040 form to the IRS.

    Is there a form that I need to fill out that and send in with my 1040 that lets the IRS know that I filed for BK and that is why I am not sending them my payment for what I owe. Or do I just set in the 1040 with no payment? They were on the List of Creditors so they should have received some info already.

    We sent our 1040 in without a payment & a two copies to our lawyer (one for them and one for trustee). We did get a letter from IRS stating what we owed, but there was that "if you are in bankruptcy, something, something, something... informational purposes only..." quote on it, same as what is on our Mortgage Statement monthly---we haven't heard from them again.

      We too included our 2001 federal and state taxes owed for that year in our filing in April 2002. Our attorney instructed us to attach to the front of the return a copy of Notice of filing that we received showing the case number, attorney, etc. with a note indicating that the IRS (or state for that filing) was included as a creditor in the filing. You will hear back from the IRS and you just direct any information you receive from the IRS to your attorney. It took the IRS several months to get us straight on their records as not owing for that year and that those taxes were included in our Chapter 13 filing. You will be transferred to their IRS bankruptcy section so any future calls about your that or future returns will be sent to that Department.
