    Surrendering a car

    My plan has been confirmed and we are at surrendering a car. I have a notice that an attorney represeting WF (car loan) has filed a motion for Relief From Stay. I e-mailed this attorney to find out where locally I can surrender the car (we purchased the car in another state) and have not heard back from him. Will they just repossess it once the stay has been lifted or will they contact us first? Anyone know how this works?

    I can tell you that since you have filed and are represented by an attorney, the attorney will not answer your email but will only work with your attorney not directly with you since you are represented now. Contact your attorney and advise him that you attempted to contact that attorney via email. Your attorney will advise you what to do.

      When we surrendered a car, Toyota filed a motion from relief of stay (end of November). Just before the time limit of responding, our attorney filed a notice of non-opposition, basically "allowing" Toyota to sell the car / releasing it from the BK estate. This is the paperwork that had me a nervous nellie, and looking back, there was nothing to be nervous about. Our attorney didn't "jump" on it because it didn't need "jumping" on, kwim?

      We turned the car in shortly after filing. Make sure you get documentation from whoever you turn it into.
