    So many questions, please help

    Hello all,

    I have a rather complex situation and I am looking for some guidance. We are a military family who is needing to file Chapter 13 soon due to massive amounts of CC debt that our Credit Union refuses to assist us with resolving. We have been paying them through a DMP for the past 6 months after falling 2 months behind when I lost my job last summer.
    And even though we have been paying the more than the minimums, it doesn't cover the arrearages and they went ahead and charged 3 of the accounts off. Which doesn't make any sense to me, but such is life. We now know that we need to file, because it's far better than charge off's on our credit reports. We filed a 7 6 years ago, and everything was going well (except we were not very wise and got back into debt) until I lost my job, and then everything went to crap in a hurry.
    Therefore, we have to file a 13. I never want to see another Credit Card in my life after this!!

    Ok, well the situation is that we are Ohio residents, but we live in New Jersey. Or at least we do when my husband is home. He is currently in Iraq and by the time he returns and we are back in NJ for 90+ days, it will be too late for us to file. We really need to do it now.

    It is my understanding that I can file with his POA, has anyone had experience with that? I have printed off the statement of military service for him to sign and he is writing a statement as well to go along with the POA stating that he understands that I am filing on his behalf, etc. He will also be sending me photo copies of his DL and Military ID for the filing.

    I am strongly considering filing Pro Se, as we have no real assets. We have two vehicles that we will put in the plan, but we do not own real estate or anything else. Like I said, we are perfect candidates for a 7, but we cannot file now due to the time limits. I cannot see paying an attorney more than $3k for a no asset case. After our car payments and allowable expenses, we will only have, on paper, about $150 per month disposable income. Has anyone filed a 13 Pro Se? Is it difficult?

    Since you are military, you will need to contact family services on your base and find out what you need to do. Please thank your husband for his sacrifice and service for our country.
