    Ch 13 & mortgage arrears

    I will owe July & Aug. mortgage payments, which I plan to include as part of the plan.

    There is currently a backlog in our local area, and I am concerned that my filing might not actually take place until September. If that is the case, and I owe 3x mortgage payments due, will I encounter additional problems?

    For example, I know once 3 payments are due, that the mortgage company will not accept just 1 payment. Will it just keep getting further behind while waiting on my plan to be confirmed?

    I had anticipated rolling the arrears into the plan, and paying the current/future payments on my own (never late again!).

    Filings are electronic so the filing itself doesn't matter nor does the backlog of filings. Once you are filed and have that case number, you are protected and you can provide that number to your mortgage company. Your attorney will instruct you about how the late payments will be handled. You don't mention whether or not you have consulted an attorney yet - I don't think you have or you would have been advised as to what would occur as to your late payments.
