    Anyone go to their confirmation hearing?

    Hello-
    I am new to the forum. I filed on June 13, 2008. My 341 was yesterday. It was not as bad as I thought it would be. My trustee is very kind and has is very easy to talk to.

    My question is, my confirmation hearing is set for August 14. My lawyer said that his clients usually attend the hearing also. Has anyone else gone to the hearing and if so, what was it like?

    Hi there,

    First of all, congrats on you 341 going so well! I haven't filed yet (ch 13), but if you don't mind give us some details of your 341 (for those of us who haven't filed and are neverous as heck!).
    Where do you live?
    Was your repayment plan accepted?
    How close to the IRS standards were you?
    Stuff like that...

          If the plan is going to be confirmed, there is usually no reason for the debtor to attend.

          Basically, confirmation goes like this.

          Judge or Judge's Clerk:
          "Now calling case number xxxxxxxxx, In Re xyz

          Trustee: The trustee recommends confirmation.

          Judge: Very well, having received no objections and after reviewing the paper work, I hereby order the plan of XYZ confirmed; next case.

          But, if your attorney is suggesting you go, you should probably go.

            We were advised we did not have to attend our confirmation hearing. Just ask your attorney whether or not you should attend - simple as that.

              My attorney told me to attend even before the 341 meeting. He said he has all clients go. I am nervous about it.

                  Finally Confirmed - Now What?

                  After a two month delay because of trustee objections, my Chapter 13 plan is finally confirmed as of 7/22/08.

                  At no time has there been mention of any post-confirmation requirements with respect to the trustee and what he or she may require in the way of proof of income as the years go by. From the postings I have read on the forum, each trustee has their own way of conducting business.

                  What I have not been able determine is exactly when such requirements, if any, will be revealed to the debtor. I don't plan on becoming wealthy in the next five years - but if all goes as planned (ha!) I will be earning between 5K and 10K more than I am now.

                    I would contact your attorney to see how your trustee wants to handle increases in income. You might be one of the lucky ones who has a trustee that doesn't care about income increases as long as you make your payments on time and stay under the radar, but certainly double-check with your attorney
