    New here - worried and have a question

    We filed for chapter 13 and have been making our trustee payments for about 6 months. They are directly withdrawn from my husband's paycheck and, since he's paid biweekly, the amount going to the trustee each month is actually slightly higher than the court order.

    My question is this: My husband recently was forced to take a pay cut. It's not enough of a cut to have our plan modified, but now that it's getting time for all the school fees, supplies, etc for our kids, I'm afraid we might miss one mortgage payment. I'm terrified they're going to come foreclose on me if that happens and want to know if anyone else has had this happen and were there any serious repercussions to missing ONLY ONE mortgage payment.

    If it makes any difference, our lender is Countrywide and we live in Illinois.

    although difficult to do perhaps your best course of acton here is to see what you can reuse from last year for your kid's school stuff and then start shopping sales and ebay to fill in the gaps. I wouldn't take a chance on missing the mortgage payment. I would rather my kids started school with fewer clothes.

      It's not even so much the clothes and things... those we'll just work at a little bit at a time like we always do. I'm more concerned about the fees. Our kids go to public school and it's still going to cost me over $500 to send them.

        When you have an expense pop up during your Plan that makes you think you cannot make your Plan payment or mortgage payment, the first thing you do is contact your attorney. Do not miss any payments because you need to put money into something else (i.e., your school expenses, water heater breaking, tire blow out, etc., etc.). There are times where trustees have allowed a plan payment to slip by for that month and add it on at the end of the Plan. Contact your attorney.

        You will need to find a way for future years on the Plan to budget that money out through the year so you will have it on had this time next year. I know it's tough but as you are finding out, Chapter 13 is not easy.

        Whatever you do, do not play guessing games during your Plan as to finances or expenses. Ask your attorney.
