    Real Estate Taxes in Chapter 13 Plan

    I was wondering if anyone else has encountered this issue with their chapter 13 plan. Filed Chapter 13 09/05, confirmed 12/05. Included 2005 Real Estate Taxes in Chapter 13. Taxes are listed as to be paid through plan. Here we are almost 36 months paid into Trustee and not one cent paid to Real Estate Taxes. My wife spoke to tax collector just this month and she claims interest and penalties keep accruing and that the original 2005 tax due has been increased by almost 30%.

    Is this legal, can the creditor add additional amounts to the confirmed amount put into the plan? Should I let my attorney know? The Trustee?

    And why hasn't the Trustee paid anything towards the Real Estate Taxes? It is the only creditor listed that has not received any monies in the almost three years we have been paying into the plan.

    Any advice would be appreciated. Thank you.

    I would be calling the trustee's office to find out why. Those should have been priority and were probably an oversight on the trustee's part. I would not wait on this.

      Contact your attorney and find out what is going on. Advise and ask him just what you stated above.
