    Paying first payment to trustee....

We are getting ready to pay our first payment to the trustee next week. My question is this...we will not be able to send the cashier's check until Friday morning, August 15th (because that is payday). Our payment is due at the trustees lock box located several states away on Monday the 18th (no time was specified). We were going to send it next day on Friday so that it would be delivered on Monday but was concerned that since we are dealing with a lock box that might be problem. Is it common practice to send it to a lock box? Will we be okay?

Most trustee's have lock boxes and you should be fine. I cannot send mine in certified receipt or anything. Just have to trust the mail. So far, so good for me.

We've always sent ours by regular mail to the trustee's lock box too and haven't had a problem. The bank will give you a receipt for your cashier's check, just make sure you hold on to it in case you do ever have any issues. I always date mine as to when I mailed it to, just to have for my records in case it were to ever get lost.

By 'lock box' I assume you mean a Postal box? We send money orders, and sometimes we put a return reciept and sometimes not--it depends on who goes to the post office. I did this month, and because the glue on the envelope was weak and the envelope was half-open, I covered it with tape and slapped the return receipt on it. That only cost around $5.00. Now, our Trustee is in the same state and only 65 miles distant. Since yours is several states away, I would almost be tempted to 'overnight' it. That costs $16.30--which is steep when you're broke. There is a place on the form to sign that you waive having the recipient sign for it.

If you wish to have 100% proof you mailed it on Friday, before you seal the envelope, purchase a 1 cent stamp and have the postal worker cancel the stamp on the check. It is a very cheap notory, and officially certified by the USPS. They MUST cancel a stamp it you request it. 'Hub

If you send it via Priority Mail on 8/15 it will get there on 8/18 - call the Post Office and ask. You can always get confirmation of receipt with Priority Mail also. When we were close on dates like that (we sent in a cashier's check as we were able to get out of payroll deduction, thankfully...), we would send it out via Priority Mail to ensure it was not late. Priority mails gets there in 2, sometimes three, days depending.

Thanks for all of your responses. We do plan to next day the payment so that it would arrive on Monday the 18th our due date. The letter from the trustee said to make sure not to send it to her post office box but to her lock box (what is a lock box?). Her post office box is actually located in the same state as me (two hours away). The lock box is located in South Carolina (I believe-need to look at the paperwork again). Why would that be? We shoudl never be this close on a payment again. I am a school teacher and we get paid one amount at the end of the school year and do not get paid again until schools starts again. My first pay day is 8/31. Normally I would have extra money left over from my summer pay but we had to use a chunk of it to pay the lawyer so that we could file.

HEY THERE Flamingo!!!! Really I don't think the Trustee would be too upset if they are a day late. I am sure they are very busy, as well as it is over the weekend. Also a first payment, etc. etc..

Good to see you Flamingo and best of luck D in Flora. 'Hub

We had the same thing. Our payment went to a P.O. Box in the lovely state of Tennessee which is quite a ways from us! You need to remember the large amount of payments the trustee receives each month from the numerous Chapter 13 cases going on, opening, closing...you don't think the trustee handles each and every check themselves do you?
