    irs

    irs just sent me a certified letter levying me 5 months after filing chapter 13.They are listed on the bankruptcy. If they take my pay i will be unable to make my pmt.

    IRS is subject to the automatic stay, just like any other creditor.

    Are they provided for in your plan?

    Were they properly served?

      Yes. They were even at the 341 meeting.

        We also had past taxes included in our Chapter 13 filing. You state they were listed in your BK so all should be fine. Make sure you send copies of that correspondence to your attorney and your attorney will contact them. We also had a late letter like that come in (we filed 4/02 and received a letter from them in August/02). As you know, things take a while with the IRS. We contacted our attorney, faxed him a copy, and it got straightened out.

          Like Flamingo stated, contact your attorney. He should be able to straighten it out. The IRS is a big bureaucracy, with automated letter generating computers and all that. Actually, I'll tell you, that the IRS is not too bad to deal with re bankruptcy issues.

            True...IRS has a special bankruptcy section so it is odd that a levy would have been sent if they actually showed up to the 341, but Bnk is right, many notices and levies are computer generated. It should be pretty easy to straighten out, but you need to stay on top of the issue and get moving.
