"just work a little overtime" ?

    Hi All,
I am still a month or so from filing...need to get some income out of the 6 month window.

I've seen a few posts of people suggesting one work some overtime or extra hours to get add'l spending money.

Don't the trustees see that in your next year's w2?...and won't they then give you trouble and/or raise your payment?

Your payment is based on your schedules and what will be confirmed with the trustee. If you have significant increase in income you can have your payment increased if you are not already paying 100% payback.

Also depends on your trustee and whether or not they require you to send in copies of your tax returns each year. Some do, while other do not. Others require that you send them in but will raise your payment only if your income increases 10% or more. It all varies from district to district

For me, they are factoring in 10 hrs overtime for each check as a standard (and it SUCKS, because I don't always get it...)..

I would guess that the best way to make extra money, would be to get paid under the table. It sounds pretty unethical, but you do what you have to do I suppose. Everything else will show up on your W2.

Be very careful here - this is not true in most cases.

Ch 13 trustees understand that income and expenses do vary over time. Most have adopted the 10% income increase guideline - if your income increases 10% permanently, then you COULD hear from your trustee about increasing your payments. But it's not a given. And some trustees may pull the trigger at a lower increase than 10%. Again, it depends on the trustee and the customs of your local bk court.

Ask your lawyer to see how YOUR trustee handles income earned after filing - it's the only way to reliably know what to expect.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

I am in the Eastern District of Michigan. My income has increased about 1000 a year since filing. THe only thing my trustee cared about was making sure my federal tax refunds were sent in to him as soon as I got them. So if you worked a few extra hours, I bet it wouldn't effect your plan. However, can't say what would happen if you made a LOT more.
