    Credit Cards during Chapter 13

    We still keep getting credit card offers. We filed the end of 2007. Can you get a credit card during your bankruptcy? I was thinking that our attorney told us we couldn't. Just wanted to double check. Thanks.

    No, you are not suppose to open any line of credit while in a ch 13.
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      And remember these are only offers - which are sent out by the truck/plane load. Once you actually apply they will turn you down as they will see that you are in active Chapter 13

        You need Trustee permission to incur additional debt/credit during your Chapter 13 Plan (i.e., car loan, credit cards, etc.). As Magyar stated, 99.9% of creditors will not approve anyone in an active Chapter 13 and would require permission from the Trustee as to a car loan, refinancing, etc. if the loan or refinancing could even be done.

          The instructions from our trustee are that we need his permission to take on debt of $5000 or more. Nothing about not opening new lines of credit (not that I want do).

            Thanks. I was pretty sure that's what our attorney had said. I could care less if we ever have credit cards again...that's what caused this problem in the first place. Have a great weekend!!

              Depends on trustee. some care , some don't.

                Our trustee allows you to incur debt up to 1000.00 anything over has to be approved. So I have a few credit cards and they have done wonders for my credit score while in the chapter 13.

                      How does the trustee know that you have new credit? Do they pull credit reports during the chap 13?

                        I guess it depends on where you are. I was told no credit at all without trustees approoval.

                          I have been in my chapter 13 since August 3, 2005. I didn't apply for anything until 2006 when I got my first "rebuilder card" for 300.00 But it did wonders for my score just by paying it on time every month.

                          But every trustee is different. Some allow and some don't.

                              Remember - as long as you are in Chapter 13 - you are fair game to trustees' probing into your financial affairs. Basically a suspect.
