I have only posted a few times, but wanted to share what I consider, for us anways, to be good and relieving news. Met with our attorney today and we are able to convert our 13 to a 7, which I wasn't sure we could. Will only cost us an additional $25 for the paperwork and we won't lose our tax refund as it is a straight conversion and our attorney says the income and all the information goes from the time we filed initially, so any refund that the trustee would have been entitled to would have been last years and our attorney says we used it to help fund our plan and for living expenses so there should be no problem. He told us that when we are completely and totally out of our house, to call the mortgage company and ask where to mail the keys and tell them we are shutting off the utilities. He also said that the payroll deductions for the 13 plan should be stopped by the end of October or beginning of November at the latest. That is OK, because we will have already paid up rent in our new place. So, the packing continues and we hope to be out by the end of the month. Overall, I am relieved with the news and happy to have a fresh start. I wish we could of made our plan work, but in the end, there is no point in staying in a 13 to save a house that is no longer big enough for us and we qualify for a chapter 7 anyways.
