    Trustees office,they are so nice!

    I was wondering if anyone else has dealt with thier trustee's office? Ive been in contact with mine due to a car accident with injuries. I called every month waiting for the check from the insurance company for totalling my car. I was almost 4 months behind and sent the payment. They we're so understanding and sympathic.Altho they said when they review it,I should be up to date. I called today with my concerns over having 2 surgeries and being out of work. I was told I could ask for a 3 month extension. Also discussed the lawyer not returning my calls *laughs* she says make an appointment,they would rather talk to me on the phone than have me in there. Also helped me with what my injury attorney has to file.......Im guessing any settlement I get will go to pay off my bankruptcy. Maybe thats why there so nice!......Nice to know they care,cause they attorneys are driving me nuts.

    Did your accident happen before you filed or after?

    If it happened *before* you filed, then yes, the trustee could take none/some/most/all of the settlement - just depends on how sympathetic your trustee is. However, if the accident happened *after* you filed, then that puts a different spin on things.

    As your trustee's office recommended, make an office appointment with your lawyer to sort out what's going to happen in this situation.

    I hope and pray that you will get to keep the insurance settlement - you deserve to have it after all you've been through. Unfortunately what you deserve and what the law allows a trustee to do during an active bankruptcy are all too often not compatible.

    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      It happened 9 months after I filed. I would rather pay off the bankruptcy then have it hanging over my head.Yeah,umm seems after they approved my bankruptcy my attorney is "always busy" "legal assitant will call you back." right. Good news 1yr into bankruptcy,$9800 still owing.......Im starting to see the light at the end
