    Adding names to deed while in Chapter 13

    I understand if I transferred property less than one year to a spouse, parent or sibling or anyone else prior to filing chapter 13, the Trustee could consider this move fraud.

    Question: What if I am in the plan and decide 6 months into the plan I want to add my sister to the deed that is free and clear of any mortgage, just property taxes and insurance need to be paid monthly.

    1. First can I actually do the above in a plan?
    2. If yes, do I have to ask the Trustee for permission before adding names to a deed?
    3. If no, then when can I add names to the deed --- would I have to wait 60 long months?

    The property that is free and clear is considered an asset in your Chapter 13 paperwork. You cannot do anything as to that property without Trustee permission during the course of your Plan. Contact your attorney who can correctly guide you on this.
