    341 Today........

    In just about 2 hours from now.
    Nervous, didnt sleep much last night.
    Think I have everything in order.
    Got my fingers crossed.
    Time to go face the music.....

        Well..........

        I am on my way to the meeting, and I see a police car behind me lights a blazing.
        So I pull over......"Sir, did you know that you were going 70 in a 55 zone?"
        awwww crap, I ended up getting a ticket. There goes $170 I surely can not afford at the moment....

        I get to my meeting on time. I could not believe how many people were there...
        I would say there was at least 25 other cases besides mine.

        I also could not believe as to how ill prepared some of the people there were.
        One lady decides she wants to argue with the trustee, well she got kicked up to a higher court. Another lady lays into her lawyer right there in front of everyone about how "they" did not do the correct paperwork for her......

        My case comes up, thanks to this board, thanks to my luck in picking a great firm to represent me, and a thanks goes back to myself for making sure all my ducks were in a row. I snap into military mode and yes sir'ed and no sir'ed all of his questions......

        Then I hear the words I wanted to hear..."I am going to recommend your plan for confirmation"

        Sweeeeeett

        So I guess that puts me in what you guys call the 60 day club now eh?

          Oh, glad to hear that your 341 went so well! Congrats!
          You are a ch 13 case right? No 60 day club for you...did you get 3 or 5 year plan? Also, sorry about the ticket...that sucks!

            I am in a 3 year plan. I saw something on my paper work about how creditors have till april sometime to contest it or something like that. I dunno.

            Out of every bi weekly paycheck I get $60 deducted to the plan. I already have 2 months paid!! 34 to go, and then bye bye to around 45K of unsecured...

            Still learning how to live on my budget.... Today was payday....so I went out and bought a months worth of grocerys. Next paycheck mostly gets gobbled up by mortgage pmt. If I am careful I can survive. I guess I should quit smoking it would give me more $$ that is for sure.....

                $ 120 per month? Sounds like a great plan! And yes, the creditors do have 60 to respond to your petition if they want to get paid or they have an objection to the petition. I think we chapter 13'er need our "own club"

                  I originally intended on going 7, and I certainly qualified.
                  But my lawyer convinced me to go 13.
                  Part of me still does wonder if he was blowing a little smoke
                  up me arse........
                  But as he explained it........ I live in a community property state.
                  And even though we were divorced last april....(seems like divorce and
                  bankrupty tend to go hand in hand eh?)
                  And even though all the credit was in my name alone, it would still
                  be consider community property/debt.
                  That even though I most likely be granted a 7.
                  That then my creditors would have the option of going
                  after my ex. Then she could take me back to court,
                  and I could end up in a worse place than I am now!

                  So I had to sit down and think long term on it....
                  Be dumb to go through all this and end up at worse than now.
                  Not even considering all the bad will with ex, there are
                  children involved. Dont need that at all.

                  So here I am. It will work out. I think I got the most
                  workable and safe solution to this possible.

                    Sounds like you will survive this. Well done. May I ask a couple of questions? Ultimate, of the 45grand, what will you have to pay back. I guess I can do the math, if there is payments of 60 every 2 weeks, that is around 4680.00. Am I right? You are only required to pay 1/10 of the debt? Did this include vehicles or credit only? Is there a way to put vehicles in a chapter 13 repayment? And does the repayment have to be deducted from paycheck? Or can we pay the creditor directly? Thanks and I am happy that it worked out for you. We are personally treading water and make too much for chp 7... sorry for all the questions.

                      Your math is about right. I am thinking though it will be more like 5% to the creditors when all is said and done. Lawyer and trustee fees come off the top.

                      I do not have any vehicle loans. So I really do not know to much how that works, I imagine they could be rolled in though? not sure.

                      As far as deducting from paycheck I think that varies dependent on trustee decision. It works pretty good for me though..... Just adjusted my W4 and really will not feel it so much...

                      And dont be sorry at all for questions......that is what this forum is for!!!
