    what are your next steps if you default on your 13?

    i am not close to it, but id like to know what you should do if you happen to default on your ch 13. things have been so bad i imagine a lot of people will have no choice but to with so many layoffs.

    what do you do then, change it over to a chapter 7? just let the collectors start calling until the end of time?

    and what happens to all of your money if you do default that you paid into the ch 13?

    these are things i would like to know for peace of mind (or lack therof)

    Filers in a confirmed Ch 13 plan who have permanent or long-term decreases in income or significant increases in expenses can work with their lawyer to file an amended Ch 13 plan. If their income has decreased enough that they are now under the median, then they can work with their lawyer to convert their Ch 13 to a Ch 7.

    The very worst thing any Ch 13 filer can do if they can't make their Ch 13 payments is do nothing and have their Ch 13 dismissed by their trustee.

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go
