    Marriage during plan / convert?

    Hello All,

    I hope you can help. I have tried to contact my attorney with no luck. I am am in an active 13. Confirmed March 2008. 3 Year plan. I am getting married in August and was wondering will this change? How will this effect my plan. I was told I may be eligible to convert to a 7. I am concerned as I do not want this to hurt his credit or income. Should I consider converting or wait until plan exp? Do the marriage change things?

    You need to talk to your attorney on this one. Your new hubby's income will increase your household income and you probably will have to modify your plan. Who told you that you could convert to a Chapter 7 under these circumstances?

      Does getting married mean you will now be below the median? What other increase in your expenses with marriage will make you eligible for conversion? Because typically marriage helps out a financial situations (one household instead of two, two incomes, etc.) doesn't make them usually worse so that you'd now be eligible for a CH 7 conversion. (There are always exceptions of course.) But I'm finding it's not so easy to convert, even with a big change in circumstance (hubby's income went from ~$2000/month to $0!) so not sure how conversion is going to happen from your marriage. Although from reading that you are in a 3-year plan I assume you are under the median now, so you might be one of the people who can convert, but again, what has changed based on the marriage? Your attorney will need to be involved in any conversion process tho.

      Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!
