    I can't register my car b/c my property taxes are behind..

    We are currently in the middle of trying to convert to a Ch 7 but in the meantime I have a problem.

    We initially filed a Ch 13 and our property taxes where included and were paid by IN FULL by the trustee. Well my county tax office was notified when we filed and they didn't file a claim so the trustee paid them the actual amount of the taxes minus penalties and interest. It turns out he paid them in full last year and they still show penalties and interest of $300 owing. They passed a law that you can't register your vehicles if your property taxes aren't paid in full. My lawyer sent the tax office and their attorney a letter on 2 different occasions telling them that I can't legally be held liable for this and they need to write it off but they are all acting stupid and swear they never received it and don't know what I'm talking about.

    In the meantime my registration goes out the last day of this month. Now I have copies of all the letters and the letter from the trustee showing it to be paid in full but noone at the tax office or their lawyer's office seems to care.

    What now? I don't have the money to pay the penalties and I don't want to get a ticket for my registration being out. I see my lawyer again tomorrow and will ask him again what else can be done.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

    What state is this? I'm including my property taxes in my 13 too.

      This is something your attorney will have to straighten out as he withheld the penalties and interest due on taxes at the time of your filing and he has been the one corresponding with them. The issue is not the taxes owing, it's the unpaid penalties and interest incurred prior to your filing date. I don't think they can legally add additional penalties and interest after your filing date. Anyway, since you are represented by an attorney, he needs to work with them to straighten this out.
