Kansas has two bk courts - one in Kansas City, KS and the other in Wichita. I don't think we have any active members from the Wichita area right now. Each court has a different Ch 13 trustee, so how things went in KC wouldn't necessarily carry over to Wichita. Hopefully there's a member lurking who filed a 13 in the Wichita court.Originally posted by 1aliasfan View PostWichitaI am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

If your legal residence is in Missouri, you can't file a bankruptcy (13 or 7) in Kansas until your legal residence has been in KS for two years.Originally posted by vb1962 View Posti am looking to file a chapter 7 in kansas because my joint chapter 13 in missouri will be dismissed.
Frankly, filing bankruptcy is never 'a breeze' no matter where you file. There are blind spots and odd customs in every court and every trustee, no matter where they are located.i have heard from different lawyers that kansas is a breeze compared to missouri..........any thoughts? thanks.
Why is your joint Ch 13 in Missouri being dismissed?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

chapter 13 is being dismissed due to divorce. can't be converted. because i don't own any property or anything, all the attorneys i have talked to said i only need the majority of 180 days as a kansas resident (90 days). several of those attorneys mentioned that things went so much smoother in kansas than in missouri. ( i am on the state line)

You can file in Kansas (and other states) after a 91-day residence. However, until you live in a state for two years, you have to use your previous state's bankruptcy exemptions - in your case, Missouri's. See http://books.google.com/books?id=dv0...esult&resnum=9 for more details.Originally posted by vb1962 View Postchapter 13 is being dismissed due to divorce. can't be converted. because i don't own any property or anything, all the attorneys i have talked to said i only need the majority of 180 days as a kansas resident (90 days). several of those attorneys mentioned that things went so much smoother in kansas than in missouri. Are you going to be ok using Missouri's exemptions if you file Ch 7 in Kansas?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
