    How Long Can I Live in My House?

    Hello All!
    Hoping you can advise me! I had my Conformation meeting Cptr 13 yesterday and we were confirmed. Our Attorney rang with the new payment schedule today but it is much too much for us to manage......
    The Attorney says for us to surrender the house today as you have three days to change our minds after conformation.
    We live in Orlando Florida and have a Mortgage with Countrywide/Bank Of America.
    Do you have any idea how long a forclosure will take and have to leave the property, the proceedings have not even begun on the house as yet as the Trustee has been making mortgage payments for us all along.

    Has a NOD been served?

    Is a Lis Pendens filed?

      Since your payments are all current, no one can say for certain how long you will be able to stay after your first late payment. Some lenders are moving more quickly on foreclosures, some not. The bad thing for you here although you have to do what is best for you is that you will have a Bankruptcy on your credit report even if dismissed, and then a foreclosure when that takes place.
