    Income Tax 2010 and Property Taxes in Ch. 13

    Hi All,

    I had about $4,000 in back property taxes that was included in my plan and the trustee paid all of it for 2009.

    Question: When I file my taxes next year, will I be able to take the $4,000 as a deduction for 2009 even if I actually paid the trustee (my monthly plan payment) and they in return sent a check to my local property tax department?

      The answer is yes. You get to claim property taxes on IRS Form 1040 Schedule A in the year in which you made the payment. For Chapter 13s, a creditor is considered paid when you pay the Trustee.
