As long as the business debts are guaranteed by you, not by the business itself, you can file an individual consumer Ch 13 and include the business debts.Originally posted by jonance View PostIf my debts are primarily business debts and I file a Chapter 13, is it treated any differently than a consumer chapter 13?
According to NOLO, "A business, even a sole proprietorship, cannot file for Chapter 13 bankruptcy in the name of that business. ... If you own a business, however, you can file for Chapter 13 bankruptcy as an individual. You can include in your Chapter 13 bankruptcy case business-related debts for which you are personally liable." See http://www.nolo.com/legal-encycloped...cle-29738.html for more details.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
