    Question about Schedule F of BK paperwork

    Not sure if anyone will know the answer, but worth a shot.

    We worked with a debt service for almost 2 years prior to filing for BK (C13) in November. In that time they settled 3 of our cc's. Our attorney had us add them to the schedule F, though they were already settled, to help protect us later on.

    Because they are added to the schedule F of the BK paperwork, when we file our taxes do we need to
    A) Claim the amount listed on the 1099 as income

    B) Claim insolvency (and complete the insolvency paperwork required) so we don't HAVE to claim the amount on the 1099's as income

    C) Do nothing because they are included as part of our BK?

    Ask your lawyer. He/she knows all the circumstances of your specific case. My guess is that the answer is going to be C. but I'm not a lawyer. Only your lawyer can tell you that for sure.

    Just curious....did the three settled cc's file claims to be paid in your Ch 13?

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      I've put in an email to our attorney, but I'm pretty sure we're going to need to file a form 982 and claim insolvency. I appreciate the response though!
