My husband is going to be receiving SS benefits and we are in Ch 13, would that go towards the ch 13 BK or is that exempt????? Also he will still be working.

We just received our last check that was coming in my husband's name for our son. Even though it was benefits for our son it was calculated in when figuring how much our payments would be. Now we have to go through the hassle of having to ask for a modification and hoping the trustee goes for it.
And to add insult to injury, we received a letter from Social Security stating that if we had saved any of the money we received for our son, we had to return it, along with any interest it had earned. Not that we were ever able to save any for him- boy I would have been hot if we had.Chapter 13 filed -8/12/04
