    Husband to receive SS benefits would that go to Trustee

    My husband is going to be receiving SS benefits and we are in Ch 13, would that go towards the ch 13 BK or is that exempt????? Also he will still be working.

    In my personal experience, they WILL count the SS towards your income totals and therefore your payments will be larger than if you didn't have the SS income. We just received our last check that was coming in my husband's name for our son. Even though it was benefits for our son it was calculated in when figuring how much our payments would be. Now we have to go through the hassle of having to ask for a modification and hoping the trustee goes for it.
    And to add insult to injury, we received a letter from Social Security stating that if we had saved any of the money we received for our son, we had to return it, along with any interest it had earned. Not that we were ever able to save any for him- boy I would have been hot if we had.

      Yup, they sure do. I am on Disability and they count all money.

        Hmm, My grandma is in a 13 and they did not count SS as income. Maybe it varies state to state

          I get SSD for me and my kids and they counted all of it on top of my husbands income. Bummer......
