    Worried I will miss something

    I have been working on getting things together for my bankruptcy. I am going on April 7th to do everything. I have already retained my atty, and now I am getting everything ready. What are some things that I may miss?

    Make sure you have titles to everything and check those titles and deeds for "liens"...... make SURE EVERYTHING IS RECORDED AT THE COURTHOUSE - MAJOR ITEM......

    Pull a copy of your credit report now - to make sure you do not miss any creditors that you might have forgotten about (old doctor/medical bills, etc).... This will also give you all the addresses you need for your creditors. And any hidden collection agencies that might have an old bill on you.

    The day you file make sure there is not a lot of cash in your checking account or savings account unless you can exempt it... Do not write a large check to empty your checking account, write a few small ones.

      Better yet, on the checking account, go to Wal-Mart and purchase money orders for bills. Use your Debit card, if you have one, to purchase the MO's. If you don't have a Debit Card, add up the amounts of your bills, and cash a check at your bank to purchase the MO's. Get's the money outa your acct immediately. Fill out those MO's and put them in the mail. Money gone. Bills paid. Be sure to save the MO purchase receipt and stubs as evidence.

      Have as little in your account as possible on the day you file. It's cash you have to cover with an exemption or the Trustee will take it.

      Deed to your house. You'll need the deed to your house. And Titles for vehilces like Minny said.

      6 months of pay stubs. Even tho all the attnys said they needed to see 60 days worth, ours physically wants 6 months on hand. He wants no room for the Trustee to balk I guess.

      Have the last year's bank statements handy just in case you need them.

      You most recent CC statements. Any letters or correspondence you've received from Creditors. Also, have as many months of CC bills you've kept around handy and available too. Someone may wanna see those for whatever reason.

      Copies of your Credit Reports. You can get those free at annualcreditreport.com .

            6 months of pay stubs is for the means test. It is the law now. My lawyer wanted the 6 months of bank statements, and pretty much 3 months of everything else.

            Where do you go to get deeds for your propery? Should I have them?

                At the Court House. And yep. You're gonna need it.

                You need titles to all property you own.

                If you need vehicle titles, you'll have to order those from the State. It can take several weeks to get, or it can go fast. Kinda depends on how busy they are at the Capital.

                Also, our attny has said to have 12 months of bank statements available. Not that he needs that far back for the BK. But the Court can ask for the info. Better to have it and not need it than need it and not have it.

                  Parden my ignorance, but doesn't the loan company have the title to the house until it is paid off? Confused right now.

                    I totally agree with jman. If you are not a drinker, start figuring out what tastes best. Budget it in somehow.You' ll need it. I am 37 months into a 60 and totally amazed, almost every day, of how hard it all is. Not to speak down on the chapt 7 people, but once it is gone it is gone, for them. It seems as if chapt 13 folks just keep on being f***ked with, and it NEVER goes away. I am very discouraged. Job offers I can't take, broken vehicles I can't fix, poor health but cannot afford prescriptions.....and the chapt 13 system does not allow us to begin to put our lives back together. I had this mistaken idea that us chapt 13 folks would be recognized as trying, TO THE BEST OF OUR ABILITY, to make things right with our creditors,etc. Sadly mistaken. I chose 13 over 7 to save my Harley, the only thing I had left. Now I go out to ride it, and it is just a reminder of a major mistake in my life, a poor choice. I accomplished nothing. 60 years old and ain't gonna put this back together in my lifetime. Sorry for sniveling, but, in retrospect, I WOULD NEVER allow a friend or a loved one to do a chapt 13.

                      WHOOPS!! SORRY!! I got sidetracked, in my previous post, into my own misery. I was not required to provide titles to anything. I was not required to turn in my income tax returns. I was not required to prove any of my assets . I am not required to prove my yearly income. I was never set up for a yearly review. I was just set up on a terrible repayment plan, with no wiggle room, and have never hear a word since.

                      The mistake I made, in retrospect, was to not include in my submitted budget things I thought were very small and not important....like prescriptions (at the time) and clothing and even insurance costs for vehicles. I was also afraid to list, so I didn't, cable TV and cell phone service and the like. Look at ALL your expenses, LISt them all, the court will disallow what they don't think fits.

                        Okay, I do not own any houses or land. I own my 2 cars (one my husbands) I have the title to his, but the other title is being held by a loan company who I got a 1,000 loan through to buy christmas for my kids. They will not give me a copy of it. I had told them that I was filing and they told me, fine, cant talk to ya. Do not know how to get that now.


                        I do not have an active bank account. I have one that I am filing on the balance of but not one that I am useing, so what do I do about that?

                        I have pulled all 3 credit reports for my husband and myself, so I have the info off those, but I also had stuff that was not on them. I am worried I will miss something that is not on my credit report but will be on down the road. I also have 6 months of pay stubs and 4 years of income tax statements.

                          If you own a home and are behind in your housepayment, Chapter 13 is better, however, the mortgage Co may charge you extra fee's, or interest after the Chapte 13 is discharged. In you case, it would better to do a Chapter 7.
                          If you are young, got young kids, it will only stay on your credit report for 7 years, while a 13 will stay on much longer. I have done both Chapter 13, and 7. I had to file Chapter 7, because Chapter 13 is really a complicated mess. And they don't care if you are trying to do the right thing and pay your bills off, You'd be surprised at the offers for credit you will get after your Chapter 7 is discharged too! You have to owe a certain amount to do a Chapter 7 though.

                            I am not able to do a 7 b/c my husband filed a 7 6 years ago when he broke his back. A 13 is my only option and he has to file with me b/c we have so many joint accounts. We made really stupid choices and there is no other way out.

                              Your attny should be able to get the appropriate records for you on the bank acct., and a copy of your Title on the Vehicle from the Lender.

                              Don't worry if you don't have each and every doc the Court is gonna require by the time you file. You've got until the 341 to produce all that stuff. Your attny should see to aquiring anything you can't provide on your own.

                              Like we can get copies of our utilities statements, and things like that regular folk can take care of. But maybe the Lender is holding the Title to a vehicle. Things like that and your bank acct, the attny may have to get that stuff.

                              Attnys are gonna request transcripts of our tax returns from the IRS. Our copies aren't good enough for the Court, it seems.

                              So if you can't get something, your attny should be able to get it for you.
