    Ch 13 secured limits and new job...

    Currently have a foreclosure on a secured debt (rental property commercial loan) that left me with $1,300,000 of deficiency; no judgment against me on that yet. Also have $100K of credit card debt. Starting a new job that pays about $7000 per month (was making $2000 per month) and concerned that somehow I'll have to make payments on debts if I file Ch 7 or my Ch 7 may get dismissed due to new higher income. I know I'm over limits for Ch 13 for secured debt but still concerned.

    Going to see my BK attorney next week to discuss.

    Any thoughts?

    You sound like a "non-consumer" case - more than 50% of your entire amount of debt is related to business. If so, you already qualify for a 7. If you are a non-consumer case your monthly income is not an issue.
