    Can I file BK-13 ( pay 100% into the plan) after getting a BK-7 discharge a year ago?

    Hello,

    I filed BK-7 and received a discharged about a year ago. Can I file BK-13 right now and pay 100% in the the plan for the past due amounts on my two mortgages? I understand if you file a prior BK-7 you will need to wait 4 years to file a Bk-13, but in my situation, I would like to file BK-13 immediately and commit to 100% to the Plan.

    Please help!

    Yes, you can do that. The 4 years is how long you have to wait to file a Chap 13 if you want to receive a discharge in the 13. You aren't looking for a discharge, just the opportunity to get the mortgage payment caught up.
