    when does 13 fall off credit report and how

    My husband filed a 13 in 4/2005, completed in 8/2008. A 13 comes off your credit report after 7 years and not 10 like a 7 correct? In April, do we request from the credit reporting agencies to drop the bankruptcy filing since it will have been 7 years? Time really does go by fast for all that are still in one.

    I am pretty sure a 13 comes off your report 7 years from discharge date. This is the only one that comes off that way. A 7 comes off 10 yrs from date of filing. Hth

      df04527and helpess, A completed ch 13 comes from 7 years from filing not discharge. A dismissed ch13 stays on 10.

        Chapter 7 = 10 years from the date filed.
        Chapter 13 = 7 years frim the date filed IF IT HAS BEEN DISCHARGED. 10 years from the date filed IF ITWAS NOT DISCHARGED.

        Now in May 2012 it is time to check all three credit reports to make sure it was dropped off your reports. if not submit letter to the credit reporting agencies with a copy of your discharge and they will clear it up. ( don't forget return reciept )

          Timeline info for you...

          Filed 4/02
          4/09 - 7 years from filing date
          5/09 - checked all three credit reports and all BK info, including court info, was removed. Some cleanup necessary as to minor items.

          Now what you will run into is not having enough credit info on your credit reports but remember that your BK filing is kept permanently by creditors that you listed in your filing and they probably will not ever extend credit to you again if you apply to them or any of their subsidiaries anytime in the future.

            I read on here that Captial One extended credit to many people who included them in their BK and pretty soon after discharge? Are they an exception?
            Filed 11/17/11 Chapter 13, 341 meeting 12/21/11. Plan confirmed 1/19/12 - DISCHARGED 12/16/15

              Probably as they one of the creditors that cater to folks with previous or bad credit. They don't have to approve someone with bad credit though, if they apply.
