    Hi this question is for anyone who can give me an answer. Here it is. If I am in a 60 month plan which month do i began the date of filing th 13 or the month the plan was confirmed? thanks for your answers in advance

    If I understand it correctly (someone correct me if I'm wrong), you start from the date of filing--you are actually making payments to your proposed plan before it is confirmed.

        Yep!

        Your attny will figure up a plan payment for you. You HAVE to have sent that first payment in before you ever appear at your 341. If you don't, you're gonna have trouble with the Court about why they haven't seen their money from you.

        Your first few payments may not be exactly correct. There may be some adjustments made, by the Trustee, before your plan gets confirmed.
        Filed Ch 7 - 09/06
        Discharged - 12/2006
        Officially Declared No Asset - 03/2007
        Closed - 04/2007

          Our lawyer told us to make our first payment to our trustee within 30 days of filing or before the 341 meeting, whichever came first. When we got a page of instructions from our trustee in the mail, he said the same thing. We filed in KS.

          06/01/06 - Filed Ch 13
          06/28/06 - 341 Meeting
          07/18/06 - Confirmation Hearing - not confirmed, 3 objections
          10/05/06 - Hearing to resolve 2 trustee objections
          01/24/07 - Judge dismisses mortgage company objection
          09/27/07 - Confirmed at last!
          06/10/11 - Trustee confirms all payments made
          08/10/11 - DISCHARGED !

          10/02/11 - CASE CLOSED
          Countdown: 60 months paid, 0 months to go

            Start from your first payment due date and make 60 payments. More than likely, your first two payments will be made before confirmed but they still count. If your payment changes from the one proposed to the confirmed payment, you have to make the arrears up.

            If after confirmation, you get a raise or income changes and the plan is modified, your payments change for only what time is left, not what has passed, so you don't have to make them up.
