    Start HAMP Mortgage Modification Request Before or After Filing Chapter 13?

    Hi everyone,

    Wanted to see if anyone has any feedback as to whether it is more beneficial to start a HAMP mortgage modification request before filing a chapter 13 or after filing a chapter 13? Or does it not matter in either case?

    You should reach out to some attorneys in your area. In Florida, we have a Mortgage Modification process within the Chapter 13 bankruptcy process! We can even obtain principal reductions alongside interest reductions and/or re-amortization or the debt.

    The problem with the HAMP process is any "trial" period, the modification becoming permanent, and the modification being filed before the Chapter 13. At least in our bankruptcy districts here in Florida, we can even deal with the modification through a third-party arbitrator and even deal with subordination of junior liens... while even lien stripping! So check to see if Massachusetts bankruptcy courts have such a program.
